Supreme Court Ruling on Relentless, Inc. v. Department of Commerce and Loper Bright Enterprises v. Raimondo Puts Communities and Sacred Earth at Risk

For Immediate Release: June 28, 2024

Washington, DC– The Supreme Court of the United States handed down their decisions in the Relentless, Inc. v. Department of Commerce and Loper and Bright Enterprises v. Raimondo cases Friday morning, ending decades of legal precedent and undermining the power of federal agencies to implement legislation to address the pressing issues of our time.

Under a long-settled legal rule, the Chevron deference doctrine, administrative agencies are trusted to implement complex, often scientific, statutes, thus ensuring those with insight and professional experience handle interpretation rather than generalist judges. The rule also recognizes that when Congress writes these statutes and directs agencies to carry them out, federal agencies are empowered to fill those gaps accordingly. 

The Court’s ruling offers polluting industries the opportunity to challenge regulations they dislike in front of judges who are now emboldened to second-guess federal agencies and not enforce environmental laws.

With their decisions in Relentless and Loper Bright, the Justices have removed vital safeguards to both. By overturning one of their own important precedents, the justices have also compromised the ability of federal agencies to address pressing issues like climate change and environmental injustices as well as public health. Make no mistake, these rulings have opened the door for polluting industries to put our Sacred Earth and all of her inhabitants at great risk.”
